Ja, jeg havde ikke set det engelske svar.

De skriver: "Computer programs and business methods which have
industrial applicability are at present excluded by section
1(2)(c) of the Act."

Så Sverige er ikke de eneste, der har skrevet til SCP at de
ikke tillader patenter på software.

Det fjerner mit alvorligste anklagepunkt mod DKPTO: At deres
undladelse af oplysning om at programmel som sådan ikke kan
patenteres er den eneste grund til, at softwarepatenter ikke
er nævnt i SCPs dokument om nationale forskelle i definitionen
på "industrial applicability/utility". På side 2 er en lang
række eksempler på ting, der ikke kan patenteres efter den
nationale lovgivning i mere end eet land, men software er ikke
nævnt her (eller noget andet sted i dokumentet).

Noget kunne tyde på, at det er SCP selv, der har glemt
softwarepatenter i deres oplæg.
Ved at forsøge at få en afklaring af nationale forskelle i
"industrial applicability/utility" fremfor at afklare nationale
forskelle i det lidt bredere begreb "patentable subject matter",
kan man måske lidt bedre undskylde dette: Selvom mange lande
ikke regner software "som sådan" for patenterbare opfindelser,
kan man sige at software har "industrial applicability".
Men jeg mener nu alligevel, at software burde have været nævnt i
oplægget: På grund af dette oplæg, risikerer vi at konferencen
køres som om softwarepatenter var tilladt i alle lande.
